Energy & Ratepayer Protections
An approachable explanation of Kentucky electric utility structures, East Kentucky Power Cooperative's Data Center Power (DCP) tariff principles, and how costs are insulated from residential ratepayers.
Cave City Commerce Center proposes a primary strategy of on-site natural gas turbine generation to supply its data infrastructure. However, because data centers across Kentucky are subject to utility oversight, understanding cooperative tariffs provides important context for how large energy consumers operate responsibly within the state.
Disclaimer: Applicable utility arrangements and tariff applicability will depend on the final site service territory, engineering requirements, and formal utility agreements. East Kentucky Power Cooperative (EKPC) is not a confirmed project partner or service provider for this site, and no service agreement or tariff applicability has been finalized.
Understanding EKPC's Data Center Tariff Framework
East Kentucky Power Cooperative (EKPC) generates and transmits wholesale electricity to 16 owner-member distribution cooperatives serving over 1 million Kentucky residents across 87 counties.
To address surging electricity demand from large technology facilities without burdening families or small businesses, EKPC developed a dedicated Data Center Power (DCP) tariff framework reviewed by the Kentucky Public Service Commission (PSC).
Cost Allocation Principle
The framework is built to ensure that qualifying data center customers pay their own way—assigning the direct capital and operating costs of new infrastructure to the facility requiring it.
Dedicated Generation
Where utility grid capacity is insufficient, tariffs may require dedicated generating resources or power supply arrangements funded by the customer rather than existing cooperative members.
Advance Financial Commitments
Provisions typically include substantial upfront capital contributions, letters of credit, and take-or-pay minimum billing guarantees to shield utilities if load conditions fluctuate.
Kentucky PSC Regulatory Review
Special contract terms and tariff structures are subject to oversight and review by the Kentucky Public Service Commission to uphold fairness and consumer protection across the state.
